Embezzlement, a type of white collar crime, is a theft that occurs when someone who was entrusted to manage or monitor someone else’s money or property steals all or part of it for their personal gain. Embezzlement can arise out of an employer or employee relationship, between family members, caregivers or within an organization. The key is that the defendant had legal access to someone else’s money or goods, but not legal ownership of it. Taking money or property for one’s own gain is stealing, combined with the fact that this also violated a special position of trust, resulting in the crime of embezzlement.
