Ten Year “Step Down” Rule
In most cases, a DWI which is more than 10 years old cannot be used against you for sentencing purposes, and, as such, is not considered by the Judge. Therefore, under the 10 Year “Step-Down” Rule, a second offender could possibly be treated as a first offender and a third offender could possibly qualify for sentencing as a second offender. A fourth or greater conviction will always be treated for sentencing purposes as a third offense.
